Terms of Service
1. The service
Kestrel is a hosted application that lets an organisation connect customer PBX systems, view status and inventory, receive alerts, and take limited management actions. We do not guarantee that every 3CX edition can use the configuration API.
2. Account
You must be authorised to bind the organisation you name. You are responsible for users you add and for activity under your organisation. We may suspend access for non-payment, abuse, or risk to the service or third-party systems.
3. Customer systems
You represent that you have the right to connect each PBX. We are not the operator of your customers’ phone systems and we are not liable for call quality, 3CX defects, or outages on those systems.
4. Fees and trial
Fees are monthly, in Australian dollars, per connected PBX at the published volume rates, plus GST where applicable. A 14-day trial may apply when we open an organisation. Payment is collected by Stripe. 31 or more PBXs requires a quote. Cancel in the Stripe customer portal; access continues to the end of the paid period unless we agree otherwise.
5. Acceptable use
Do not probe, overload, or resell the service except as agreed in writing. Do not use Kestrel to access systems you do not manage.
6. Data
We process account data, connection details, status, inventory, alerts, and audit records as described in the Privacy Policy.
7. Availability and warranty
The service is provided “as is”. We do not warrant uninterrupted operation or that every outage will be detected in time for any particular purpose.
8. Liability
To the extent permitted by Australian law (including the Australian Consumer Law), we are not liable for indirect or consequential loss. Our aggregate liability is limited to the fees you paid us for Kestrel in the 12 months before the claim, except where liability cannot be limited.
9. Intellectual property
Kestrel and the software are ours or our licensors’. 3CX is a third-party trademark; we are not affiliated with or endorsed by 3CX.
10. Law
Governed by the laws of Queensland, Australia.
